1. Parties

These Terms and Conditions apply to all websites, products, programs, memberships, trainings, resources, and services operated by Barb Davies and Healing Minds Academy, including healingmindsacademy.com and related websites.

In these Terms and Conditions, “Company,” “we,” “us,” and “our” refer to Barb Davies and Healing Minds Academy.

“User,” “visitor,” “customer,” “student,” “member,” “affiliate,” “participant,” and “you” refer to any person who accesses, views, registers for, purchases from, or uses this website or any Healing Minds Academy product, program, membership, training, resource, or service.

2. Age and Authority to Purchase

You must be at least 18 years old, or the age of majority in your place of residence, to purchase Healing Minds Academy products, programs, memberships, trainings, resources, or services.

By making a purchase, creating an account, registering for a program, or agreeing to these Terms and Conditions, you confirm that you are legally able to enter into this agreement.

If you are purchasing on behalf of a business, organization, agency, clinic, group practice, or other entity, you confirm that you have authority to make the purchase and agree to these Terms and Conditions on behalf of that entity.

3. Use of This Website and Content

All content made available through this website, Healing Minds Academy, Barb Davies, or any related product, program, membership, training, resource, or service is provided for personal, educational, informational, and/or professional development purposes, depending on the specific offer purchased.

This content may include, but is not limited to, videos, recordings, audio files, training materials, written materials, slides, scripts, worksheets, handouts, downloads, journals, templates, exercises, graphics, images, text, documents, software, website content, course content, and other resources.

Unless otherwise stated in writing, all content is owned by Healing Minds Academy, Barb Davies, or its licensors and is protected by copyright, trademark, licensing, and other intellectual property laws.

4. Intellectual Property

You may access and use Healing Minds Academy content only as permitted by the specific product, program, membership, training, resource, or service you purchased.

Unless Healing Minds Academy gives you specific written permission, you may not copy, reproduce, republish, upload, post, transmit, distribute, teach, adapt, modify, resell, license, sublicense, share, publish, present, facilitate, or use Healing Minds Academy content for public, professional, or commercial purposes.

Any unauthorized use, copying, distribution, publication, sharing, resale, adaptation, teaching, facilitation, or commercial use of Healing Minds Academy content is a violation of these Terms and Conditions and may also violate copyright, trademark, licensing, and other intellectual property rights.

Healing Minds Academy reserves the right to protect its intellectual property and enforce these terms, including by seeking legal remedies when necessary.

5. Limited License

Subject to your compliance with these Terms and Conditions and any program-specific terms, Healing Minds Academy grants you a limited, personal, non-transferable license to access and use the content included in the specific product, program, membership, training, resource, or service you purchased.

Unless otherwise stated in writing, this license is for your own personal education, reflection, training, and/or self-development only.

This license is limited to the permissions stated in the specific offer purchased. Some programs may include additional professional-use permissions, client-use materials, practitioner materials, teaching permissions, certification rights, or licensing rights, but only when those permissions are specifically stated in writing in the applicable offer, checkout page, program description, or program-specific addendum.

Your purchase does not transfer ownership of any Healing Minds Academy content, framework, method, concept, resource, trademark, copyright, recording, training material, or intellectual property to you.

6. Linking, Framing, and Misrepresentation

You may not frame, mirror, copy, reproduce, or present Healing Minds Academy website pages, content, branding, images, videos, resources, program materials, or other materials in a way that suggests ownership, partnership, endorsement, authorization, certification, affiliation, or approval without written permission.

You may not use Healing Minds Academy names, trademarks, logos, images, program names, course names, framework names, content, or materials in a misleading, defamatory, commercial, or unauthorized manner.

Healing Minds Academy reserves the right to request removal of any unauthorized, misleading, or improper use of its names, content, branding, program materials, intellectual property, or website materials, and to enforce these terms when necessary.

7. Account Access, Passwords, and Restricted Areas

Some areas of the website and some products, programs, memberships, trainings, resources, or services may be available only through paid access, membership access, or registered account access.

Usernames and passwords are for individual use only and may not be shared.

Healing Minds Academy reserves the right to restrict, pause, suspend, or terminate access to any account if we reasonably believe these Terms and Conditions have been violated, login credentials are being shared, payment has not been completed, or access is being misused.

Membership software and course platforms may track concurrent logins, access activity, account use, and other usage patterns for security, account administration, and enforcement of access restrictions.

Sharing login credentials or allowing unauthorized access may result in termination of access without refund, subject to applicable law.

You are responsible for keeping your login information confidential.

8. Payments

Healing Minds Academy may offer paid products, programs, memberships, trainings, resources, or services through this website or related platforms.

Payments may be processed by third-party payment processors, including Kajabi Payments and Stripe. Healing Minds Academy does not store or collect your full payment card details. Payment information is provided directly to the payment processor, whose use of your personal information is governed by its own privacy policy and terms.

By purchasing a product, program, membership, training, resource, or service, you agree to pay the full amount stated at checkout, including any applicable taxes, payment plan amounts, or recurring fees.

9. Installment Plans and Recurring Payments

If you choose an installment or payment plan, you are purchasing the applicable product or program using a payment arrangement rather than purchasing a month-to-month subscription, unless the offer is specifically identified as a subscription or membership.

You are responsible for completing all scheduled payments associated with the purchase.

If a scheduled payment is unsuccessful, access to the program and associated resources may be automatically paused or revoked by the platform.

Missed or failed payments do not cancel your payment obligation.

Stopping participation, withdrawing from a program, or ceasing to access program materials does not automatically cancel remaining installment payments unless otherwise provided by the applicable refund policy, agreed to by Healing Minds Academy in writing, or required by law.

Access may be reinstated once outstanding payments are successfully received.

10. Refunds and Warranties

Refund policies vary by program, product, service, offer, or payment option. The refund policy that applies to your purchase will be stated on the checkout page, sales page, program description, or program-specific terms in effect at the time of purchase.

Because many Healing Minds Academy products are digital products, online courses, recordings, downloads, templates, scripts, training materials, or membership-based resources, access to the content may begin shortly after purchase. Once digital content has been accessed, viewed, downloaded, or consumed, the information cannot be returned.

Refund requests must be submitted in writing to [email protected] within the refund period stated for the specific offer purchased.

If no specific refund policy is stated for a particular product, program, membership, training, resource, or service, all sales are considered final, except where a refund or cancellation right is required by applicable law.

Nothing in these Terms and Conditions limits any refund, cancellation, or other consumer right that cannot legally be waived.

Content is provided “as-is.”

Healing Minds Academy does not guarantee uninterrupted access to the website, course platform, membership platform, videos, downloads, or other digital resources. Temporary interruptions may occur due to maintenance, platform changes, technical issues, third-party service problems, internet disruption, payment processing issues, or other circumstances outside our reasonable control.

11. Program-Specific Terms

Some Healing Minds Academy products, programs, memberships, trainings, resources, or services may include additional terms, conditions, permissions, restrictions, refund policies, licensing terms, certification requirements, or professional-use rules.

If a program-specific addendum, checkout agreement, sales page, program description, or written agreement applies to your purchase, those terms are incorporated into these Terms and Conditions.

If there is a conflict between these general Terms and Conditions and a program-specific addendum, the program-specific addendum will apply to that specific program or offer.

12. No Medical, Legal, Financial, or Emergency Advice

No content on this website or in any Healing Minds Academy product, program, membership, training, resource, or service is intended to replace medical care, mental health treatment, legal advice, financial advice, crisis support, or emergency services.

If you require medical, legal, financial, mental health crisis, or emergency support, please seek assistance from the appropriate qualified professional or emergency service.

13. No Guarantees

Healing Minds Academy may provide education, training, tools, strategies, practices, scripts, frameworks, exercises, resources, and professional development materials.

We do not guarantee specific personal, therapeutic, emotional, professional, financial, business, client, student, or practice outcomes.

Your results depend on many factors, including your participation, implementation, personal circumstances, professional scope, training, experience, effort, market conditions, and the support you seek when needed.

14. Business, Professional, and Earnings Disclaimer

Some Healing Minds Academy products, programs, trainings, resources, or services may include information related to business, professional practice, pricing, marketing, client work, certification, income, or professional development.

When business, professional, income, or practice-related information is provided, it is for educational and informational purposes only.

Healing Minds Academy does not guarantee that you will earn money, increase your income, grow your business, attract clients, receive referrals, become certified, gain employment, achieve professional recognition, or experience any particular business, professional, financial, or client outcome.

Any income examples, business examples, professional examples, testimonials, or case studies are not promises or guarantees of future results.

Business and professional outcomes are affected by many factors outside our control, including your training, credentials, experience, skills, effort, market conditions, niche, audience, pricing, messaging, implementation, professional scope, legal obligations, and business decisions.

You are responsible for evaluating your own business decisions, income potential, professional risks, scope of practice, and legal or regulatory obligations.

15. Testimonials, Feedback, and Submissions

If you voluntarily provide Healing Minds Academy with feedback, suggestions, ideas, questions, or comments, you agree that we may use that feedback internally for educational, administrative, program-development, and business-improvement purposes.

Healing Minds Academy will not treat an ordinary class comment, assignment, private communication, student submission, personal disclosure, or feedback message as permission to publicly identify you or use your personal story for marketing.

If you provide a testimonial specifically for promotional or marketing use, or separately consent to such use, Healing Minds Academy may publish or share the testimonial in accordance with the permission provided.

Healing Minds Academy will not intentionally publish personally identifying information, photographs, video, audio, personal stories, or private student information for promotional or marketing purposes without appropriate permission.

16. Privacy

Healing Minds Academy will collect, use, disclose, and protect personal information in accordance with its Privacy Policy and applicable privacy requirements.

Personal information may be disclosed to third-party service providers where reasonably necessary to process purchases, operate websites or course platforms, communicate with customers and students, provide purchased services, maintain security, or comply with legal obligations.

Healing Minds Academy uses commercially reasonable efforts to protect website, account, payment, and customer information. However, no website, course platform, payment system, email platform, or password-protected system can be guaranteed to be completely secure.

You acknowledge that unauthorized access, technical issues, data loss, or security incidents may occur despite reasonable precautions.

18. Third-Party Services

Healing Minds Academy may use third-party platforms and service providers, including but not limited to Kajabi, Stripe, email marketing platforms, video hosting platforms, scheduling tools, webinar platforms, social media platforms, and other technology providers.

Healing Minds Academy is not responsible for performance problems, outages, data issues, payment processing issues, service interruptions, account restrictions, policy changes, or other problems caused by third-party platforms or service providers that are outside Healing Minds Academy's reasonable control.

Your use of third-party platforms may also be governed by their own terms and privacy policies.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Healing Minds Academy, Barb Davies, and any related directors, officers, employees, contractors, agents, affiliates, and licensors shall not be liable for indirect, incidental, consequential, special, punitive, or reliance damages arising out of or relating to your use of this website or any Healing Minds Academy product, program, membership, training, resource, or service.

This may include, where permitted by law, loss of income, loss of business, loss of clients, loss of data, service interruptions, technology problems, reliance on content, or professional or business decisions made based on the content.

Nothing in these Terms and Conditions excludes or limits liability where doing so would be prohibited by applicable law or limits any legal or consumer right that cannot be waived.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Healing Minds Academy, Barb Davies, and any related directors, officers, employees, contractors, agents, affiliates, and licensors from claims, damages, losses, liabilities, costs, or expenses arising out of or relating to:

• your material breach of these Terms and Conditions;

• your unauthorized or unlawful misuse of Healing Minds Academy content;

• your violation of applicable law, regulation, professional standard, or third-party rights;

• your independent professional use of Healing Minds Academy training or materials;

• services you independently provide to clients or other individuals; or

• your conduct in connection with this website or any related platform.

This provision does not apply to the extent a claim results from Healing Minds Academy's own conduct for which liability cannot legally be excluded.

21. Right to Refuse or Remove Access

Healing Minds Academy reserves the right to refuse, restrict, pause, suspend, or terminate access to any website, account, product, program, membership, training, resource, service, community, or platform where we reasonably believe a user has violated these Terms and Conditions, violated program-specific terms, misused content, shared login credentials, failed to complete required payment, harassed another participant, compromised the privacy or safety of others, or engaged in materially disruptive or inappropriate conduct.

Where appropriate in the circumstances, Healing Minds Academy may provide notice or an opportunity to address the issue before access is permanently terminated.

Termination for violation of these Terms does not automatically eliminate outstanding payment obligations or create a right to a refund, except where required by applicable law.

22. Content Updates, Availability, and Lifetime Access

Healing Minds Academy may update, revise, reorganize, replace, remove, or discontinue content, resources, lessons, downloads, platforms, communities, or program features from time to time.

Where a product or program expressly includes “lifetime access,” lifetime access means access to the applicable core content for as long as Healing Minds Academy continues to operate and make that product, program, or its successor available through a course platform.

Lifetime access does not guarantee that any particular technology platform, community, live event, bonus, cohort-specific recording, guest contribution, delivery format, or individual resource will remain available indefinitely.

Healing Minds Academy may migrate content to another platform, combine older programs with updated or successor versions, replace outdated materials with updated materials, or otherwise change how lifetime-access content is organized and delivered.

23. Disputes, Governing Law, and Jurisdiction

If a concern or dispute arises, you agree to contact Healing Minds Academy first at [email protected] so we can make a reasonable effort to resolve the matter informally.

These Terms and Conditions, including any program-specific addenda, shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

To the extent permitted by law, any dispute, claim, or proceeding arising from or relating to this website, Healing Minds Academy, Barb Davies, any related program, product, service, or any purchase made through this website shall be brought in the courts or applicable dispute resolution forum located in Ontario, Canada.

Nothing in these Terms and Conditions is intended to limit, exclude, or override any non-waivable consumer protection rights, privacy rights, or other legal rights that may apply to you based on your place of residence.

24. Changes to These Terms

Healing Minds Academy may update these Terms and Conditions from time to time. The updated version will be posted on this page with the revised “Last Updated” date.

Updated Terms may apply to future website use, future purchases, renewals, and continued use of ongoing services where appropriate.

Material changes affecting an existing customer's payment obligations, refund rights, certification requirements, or substantive program access will not retroactively remove contractual or statutory rights that have already accrued.

Where a material change significantly affects an ongoing purchased program, Healing Minds Academy may provide notice to affected participants.

25. Severability, Waiver, and Entire Agreement

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary, where permitted, and the remaining provisions will continue in effect.

Healing Minds Academy's decision not to enforce a provision on one occasion does not constitute a waiver of that provision or the right to enforce it in the future.

These Terms and Conditions, together with any applicable program-specific addendum, checkout terms, program description, refund policy, and other written terms expressly incorporated into the purchase, constitute the agreement between you and Healing Minds Academy regarding the applicable purchase.

Informal conversations, social media communications, or oral statements do not modify these Terms unless the modification is confirmed by Healing Minds Academy in writing.

26. Events Beyond Reasonable Control

Healing Minds Academy will not be considered in breach of these Terms for delays, interruptions, rescheduling, or inability to perform caused by circumstances reasonably beyond its control, including serious illness or incapacity, emergencies, severe weather, natural disasters, internet or technology failures, platform outages, government restrictions, labour disruptions, or similar events.

Where such circumstances materially affect an ongoing program, Healing Minds Academy will make reasonable efforts to reschedule affected services, provide alternative delivery, substitute appropriate instruction where feasible, or otherwise provide a reasonable means of completing the affected portion of the program.

If Healing Minds Academy permanently becomes unable to deliver a material portion of a paid program and cannot provide a reasonable alternative, participants will be entitled to an appropriate refund for the undelivered portion, subject to applicable law.

Program-Specific Addendum

The following program-specific addendum applies only to the program named below.

If there is a conflict between the general Healing Minds Academy Terms and Conditions and this program-specific addendum, this program-specific addendum applies to that specific program or offer.

Hypnosis Certification Program Addendum

This section applies specifically to the Healing Minds Academy Hypnosis Certification Program.

By purchasing, registering for, accessing, or participating in the Hypnosis Certification Program, you agree to the Healing Minds Academy Terms and Conditions as well as the hypnosis-certification-specific terms below.

Program Access

The Hypnosis Certification Program includes access to the core course materials, training videos, live or recorded classes, practice activities, resources, and any additional materials specifically included in the offer purchased.

Participants who successfully purchase the program receive lifetime access to the core Hypnosis Certification training library, including updates and upgrades to the core training materials, for as long as Healing Minds Academy continues to operate and make the Hypnosis Certification Program or its successor available.

Healing Minds Academy may update, reorganize, replace, consolidate, or migrate the training library over time. Graduates from previous cohorts may be moved into newer or successor versions of the program so that they continue to have access to current core training rather than outdated versions.

Lifetime access to the core training library does not include a guarantee of permanent access to cohort-specific live-class recordings, communities, live events, practice sessions, guest presentations, technology platforms, or bonuses unless specifically stated otherwise.

Cohort-Specific Class Recordings

Live classes may be recorded and made available to participants for educational purposes, including review by participants who attended the class and access by members of the applicable training cohort.

Because live-class recordings may include student questions, discussions, demonstrations, or participation, cohort-specific recordings are not considered part of the permanent core training library.

Unless otherwise stated, Healing Minds Academy intends to make cohort-specific class recordings available during the applicable training cohort and for approximately 12 months following the scheduled completion of that cohort. Healing Minds Academy may archive or remove those recordings after that period.

Healing Minds Academy is not required to permanently retain or individually provide archived class recordings after the applicable access period.

Recording and Participant Privacy

By participating in a live class that is identified as being recorded, you understand that your name, voice, image, questions, comments, or participation may be captured in the recording and made available to other authorized participants for educational and program-replay purposes.

Healing Minds Academy will not use identifiable student class recordings, demonstrations, personal disclosures, photographs, voice recordings, or video recordings for public advertising, social media, testimonials, or promotional marketing without separate appropriate permission.

Participants may choose to limit their identifiable participation in a recorded class where reasonably practicable, such as by keeping their camera off or refraining from sharing personal information.

Participants may not independently record, download, reproduce, distribute, publish, upload, livestream, share, or provide access to live classes or class recordings unless Healing Minds Academy specifically authorizes it.

Confidentiality and Student Privacy

Professional training may involve discussion, demonstrations, experiential exercises, questions, peer practice, case examples, and voluntary personal disclosure.

Participants must respect the privacy and confidentiality of other students and practice participants.

Information disclosed by or about another participant during a class, demonstration, practice session, community discussion, private group, or other program activity must not be shared outside the learning environment without that person's permission.

Participants may not post, publish, record, screenshot, reproduce, share, or use another participant's personal disclosure, demonstration, image, voice, experience, identifying information, or practice material for social media, marketing, teaching, case examples, or other public or professional purposes without appropriate consent.

This confidentiality obligation continues after the participant completes, withdraws from, or otherwise leaves the program.

Nothing in this provision prevents disclosure where required by law or where disclosure is reasonably necessary to address an immediate and serious safety concern.

Experiential Learning and Practice

The Hypnosis Certification Program may include demonstrations, experiential exercises, hypnosis practice, peer practice, and other interactive learning activities.

Participants may be invited to experience hypnosis techniques themselves as part of their education. Participation in a particular experiential exercise may be declined where a participant is uncomfortable participating or believes participation would be inappropriate for them.

Healing Minds Academy generally seeks to use appropriate training topics for demonstrations and classroom practice rather than intentionally conducting deep therapeutic work during training.

Participants may practise course techniques with other students. Participants may also independently choose to practise with other consenting adults outside the formal class environment.

Outside practice with friends, family members, volunteers, practice partners, or other individuals is voluntary and independently arranged unless Healing Minds Academy expressly states otherwise.

When practising with another person, participants are responsible for obtaining appropriate consent, accurately representing their student status and level of training, working within their competence, complying with applicable laws and professional obligations, and referring the person to an appropriately qualified professional where necessary.

Participation in the program does not make Healing Minds Academy responsible for independently arranged practice activities or services provided by students outside Healing Minds Academy classes or supervised activities.

Certification and Certificate of Completion

Purchase or attendance alone does not guarantee successful completion or professional certification.

Healing Minds Academy provides the education and training required by the Hypnosis Certification Program and issues a Certificate of Completion to participants who satisfactorily complete the applicable program requirements.

Successful completion of the Healing Minds Academy Hypnosis Certification Program satisfies the applicable training requirements for certification through the International Certification Board of Clinical Hypnotherapy (ICBCH).

Professional certification credentials are issued by ICBCH and are subject to ICBCH's certification requirements, policies, ethical standards, eligibility requirements, and decisions.

Depending on the participant's qualifications and applicable ICBCH requirements, the professional credential may include Certified Clinical Hypnotherapist (CCH) or Certified Professional Hypnotist (CPH).

Healing Minds Academy does not independently issue the CCH or CPH professional credential and cannot guarantee a credentialing decision made independently by ICBCH.

Certification Requirements and Competence

To receive a Healing Minds Academy Certificate of Completion and be confirmed as having successfully completed the program, participants must satisfactorily complete the requirements communicated for their training cohort.

Requirements may include:

• completion of required lessons and educational components;

• required live attendance or approved alternatives;

• practice activities;

• assignments;

• demonstrations of hypnosis skills;

• evaluations or assessments;

• participation in required certification activities;

• compliance with the program Code of Ethics; and

• demonstration of sufficient competence to complete the program.

Healing Minds Academy may withhold its Certificate of Completion and may decline to confirm successful program completion or eligibility to ICBCH until the applicable requirements have been satisfactorily completed.

Remediation and Additional Training

Healing Minds Academy is committed to providing participants who regularly engage with the training reasonable opportunities to develop and demonstrate the skills required for successful completion.

If a participant has not completed required work or has not yet demonstrated sufficient competence by the scheduled completion date, Healing Minds Academy may require additional practice, assignments, demonstrations, remediation, evaluation, or other reasonable steps before confirming successful completion.

Ordinary feedback and remediation provided as part of the scheduled program will not normally incur an additional fee.

If completion requires substantial additional individual instruction, private evaluation, private certification, or attendance at a future certification session after the participant's scheduled cohort has ended, an additional reasonable fee may apply. The participant will be informed of any such fee before the additional service is provided.

Final Class or Certification Session

If the program includes a final class, certification class, demonstration, evaluation, or live certification session, attendance may be required for successful completion.

If you are unable to attend the final class or certification session as scheduled, you may attend a future scheduled certification opportunity. An additional fee may apply to cover additional instructor, administrative, or evaluation time.

Alternatively, you may request private certification or evaluation with Barb Davies, subject to availability and an additional fee.

Fees for private certification or evaluation may be higher than fees associated with attending a regularly scheduled future certification session.

Ethics and Professional Conduct

Participants are expected to behave respectfully, ethically, and professionally in all classes, practice sessions, group spaces, online communities, and communications connected to the program.

Participants are also required to comply with the Code of Ethics provided within the Hypnosis Certification Program and, where applicable, ethical requirements associated with ICBCH certification.

Healing Minds Academy may restrict or remove a participant from live classes, communities, practice groups, certification activities, or the program where the participant materially violates confidentiality, harasses another person, misuses training materials, engages in serious or repeated disruptive behaviour, acts outside appropriate professional or ethical standards, or otherwise commits a serious violation of these Terms or the applicable Code of Ethics.

Where reasonably appropriate, Healing Minds Academy may first provide the participant with notice of the concern and an opportunity to correct the conduct. Serious misconduct may warrant immediate action.

Use of Hypnosis Certification Materials

Unless otherwise stated in writing, Hypnosis Certification Program materials are provided for your own education, training, and professional development.

You may use designated client-facing materials, scripts, forms, exercises, or practice resources with your own clients where those materials are specifically provided or identified for that purpose and where such use falls within your professional scope, competence, and applicable laws, regulations, and ethical standards.

You may not reproduce, resell, upload, publish, distribute, share, teach, certify others in, train other practitioners in, or create courses, trainings, certifications, memberships, workshops, manuals, digital products, or derivative training frameworks based primarily on Healing Minds Academy hypnosis certification materials without specific written permission from Healing Minds Academy.

Permission to use designated materials with individual clients does not include permission to teach, distribute, license, publish, sell, or provide those materials to other practitioners or students.

Scope of Practice and Local Laws

Participants and graduates are solely responsible for determining the laws, regulations, professional requirements, title restrictions, business requirements, advertising rules, and scope-of-practice requirements that apply where they live and practise.

Rules governing hypnosis, hypnotherapy, counselling, psychotherapy, healthcare, coaching, and related services vary between provinces, states, countries, and professional jurisdictions.

The Hypnosis Certification Program does not grant a licence to practise medicine, psychology, psychotherapy, counselling, social work, or any other regulated profession.

The program does not authorize a participant to diagnose or treat medical or mental health conditions, provide psychotherapy or other regulated health services, use a protected professional title, or engage in activities outside their existing legal or professional authority.

If you are not already licensed or otherwise legally permitted to provide regulated health or mental health services, completion of this program does not grant you that authority.

Participants are responsible for seeking appropriate legal, regulatory, insurance, or professional advice regarding their own practice when necessary.

Representation of Credentials

Participants may not represent themselves as having completed the Healing Minds Academy Hypnosis Certification Program before they have successfully completed the applicable requirements.

Participants may not represent themselves as holding an ICBCH credential until that credential has actually been granted by ICBCH.

Graduates are responsible for representing their education, Certificate of Completion, ICBCH credential, professional status, and scope of practice accurately and in accordance with applicable laws and professional requirements.

A hypnosis or hypnotherapy certification must not be represented as a government licence, regulated-health-profession credential, or authorization to provide services that the graduate is not otherwise legally permitted or professionally qualified to provide.

Misuse of Certificate or Credential

Healing Minds Academy may withdraw or revoke its own Certificate of Completion where there is clear evidence that the certificate was obtained through fraud, falsified program requirements, academic dishonesty, or other serious misrepresentation relating directly to completion of the program.

Healing Minds Academy may also withdraw permission to use HMA-specific alumni benefits, materials, branding, or representations of affiliation where a graduate materially misrepresents their relationship with Healing Minds Academy or seriously violates applicable intellectual-property rights.

Because ICBCH independently issues professional certification credentials, Healing Minds Academy does not independently revoke an ICBCH credential.

Where Healing Minds Academy becomes aware of serious conduct reasonably relevant to an ICBCH credential, it may provide relevant information to ICBCH, which will determine any action concerning its own credential according to its policies and procedures.

No Guarantee of Certification, Income, or Client Outcomes

Healing Minds Academy does not guarantee that every participant will successfully complete the program or receive an ICBCH credential.

Healing Minds Academy does not guarantee that participation in or completion of the Hypnosis Certification Program will result in income, clients, business growth, professional recognition, employment, referrals, or any specific client outcome.

Refund Policy

Refund requests for the Hypnosis Certification Program must be submitted in writing to [email protected] within 7 days from the date of the initial purchase transaction.

If approved under this voluntary refund policy, a refund will be processed for tuition paid, less a 5% CAD processing fee.

The 5% processing fee does not apply where applicable law requires a full refund or otherwise prohibits the deduction.

Refund requests received after the 7-day refund period are not eligible for a cash refund unless otherwise required by applicable law or specifically agreed to by Healing Minds Academy in writing.

After the refund period has expired, withdrawing from the program, stopping attendance, failing to complete the program, or choosing not to access the training does not automatically cancel remaining tuition obligations under a payment plan.

Discretionary Credits and Exceptional Circumstances

If you need to withdraw after the refund period because of exceptional circumstances, Healing Minds Academy may, at its discretion, provide a credit for some or all tuition paid and/or release a participant from some or all future payment obligations.

Any such accommodation is determined individually and does not create an entitlement to the same accommodation for another participant.

Unless otherwise agreed in writing, a program credit:

• has no cash value;

• is non-transferable;

• does not constitute a cash refund;

• may be used for up to two years toward another eligible Healing Minds Academy product, service, training, or workshop; and

• does not automatically cancel unpaid installments.

Any release from future payment obligations must be expressly confirmed by Healing Minds Academy in writing.

Nothing in this refund policy limits any refund or cancellation right that cannot legally be waived.

Payment Plans

If you choose a payment plan, you are purchasing the Hypnosis Certification Program using an installment arrangement rather than purchasing a month-to-month subscription.

You are responsible for completing all scheduled payments.

If a scheduled payment is unsuccessful, access to the program and associated resources may be automatically paused or revoked.

Missed or failed payments do not cancel your payment obligation.

Withdrawing from the program or ceasing participation after the refund period does not automatically cancel future installment payments.

Access may be reinstated once outstanding payments are successfully received.

Technology Requirements

Participants are responsible for maintaining reasonable access to the internet and compatible equipment necessary to access online course materials, live classes, recordings, email communications, and other program resources.

Healing Minds Academy is not responsible for a participant's individual internet connection, device problems, software incompatibility, or other technology issues outside Healing Minds Academy's reasonable control.

Where reasonably available, Healing Minds Academy may provide recordings, alternate materials, or another method of accessing educational content affected by a temporary technology issue.

Program Changes

Healing Minds Academy may reasonably update, revise, reorganize, replace, or remove lessons, resources, assignments, schedules, instructors, guest instructors, communities, technology platforms, or delivery methods as the program evolves.

Healing Minds Academy may also update certification requirements where reasonably necessary to maintain educational quality, professional standards, or compliance with applicable certifying-body requirements.

Material changes will not be used to arbitrarily deprive an enrolled participant of the reasonable opportunity to complete the program they purchased.

If a scheduled class or activity must be cancelled because of instructor illness, emergency, technology failure, severe weather, or another circumstance beyond reasonable control, Healing Minds Academy may reschedule the activity, provide substitute instruction, provide recorded or alternative instruction, or make another reasonable completion arrangement.

If Healing Minds Academy permanently becomes unable to deliver a material portion of the Hypnosis Certification Program and cannot provide a reasonable alternative or completion arrangement, affected participants will receive an appropriate refund for the portion of the paid program that cannot be delivered, subject to applicable law.
